Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets the rules for sending email and messages through Brixus365. By using the Service, you agree to follow the AUP. Breaches may result in your messages being throttled, your Account suspended, or your Account terminated.

We have these rules because email deliverability is a shared resource. Spam, abuse, or low-quality sending hurts every other Brixus365 customer. We cannot serve you if your sending practices put others at risk.

These rules apply to email, transactional API messages, and any other channel we offer (including WhatsApp messaging when enabled).

1. Affirmative consent — the core rule

You may only send messages to recipients who have given you clear, affirmative, opt-in consent to receive that type of message.

You may NOT send to:

  • Purchased, rented, or borrowed lists of any kind.
  • Email addresses you scraped, harvested, or obtained from public directories or websites.
  • Email addresses appended from third-party data brokers ("email append" services).
  • Recipients who explicitly opted out, unsubscribed, or marked your past mail as spam.
  • Recipients you cannot prove gave consent, if we ask you to demonstrate proof.

Lists obtained through any of the prohibited methods are grounds for immediate Account suspension.

2. Proof of consent

You must be able to demonstrate, on request, how, when, and where each recipient on your list opted in. Acceptable proof includes:

  • A timestamped, IP-logged signup form record.
  • A clear opt-in checkbox confirmation (not pre-checked).
  • A double opt-in confirmation flow.
  • A documented business relationship (e.g. transactional emails to your own customers about their orders).

We may request consent records during onboarding, after a complaint, or at random as part of trust and safety review.

3. Sender identification and unsubscribe (legal minimums)

Every commercial or marketing email you send must:

  • Identify the sender clearly, with your real organisation name in the From field.
  • Include a valid postal address for your organisation in the body of the email.
  • Include a one-click unsubscribe link that works without requiring login or other friction.
  • Not mislead recipients about the source, subject, or purpose of the email.

These requirements echo CAN-SPAM (USA), CASL (Canada), and GDPR consent rules. We enforce them globally for simplicity.

4. Performance thresholds

We monitor sending health continuously. Sustained breaches of these thresholds will trigger review:

These are upper bounds, not targets. Healthy senders stay well below them.

When thresholds are breached, we may:

  • Throttle your sending speed automatically;
  • Place your Account into Review status pending investigation;
  • Require you to provide consent records for the affected list;
  • Permanently suspend in cases of repeated or egregious breach.

5. Prohibited content

You may not use the Service to send messages that contain or promote:

  • Illegal activity of any kind (e.g. fraud, money laundering, illegal weapons, illegal drugs, child sexual abuse material).
  • Pornography or sexually explicit content.
  • Multi-level marketing (MLM), pyramid schemes, get-rich-quick schemes, work-from-home schemes.
  • Cryptocurrency promotion, including ICOs, "investment opportunities", trading platforms, NFT pumping. Legitimate transactional crypto messages (e.g. exchange security alerts) require pre-approval.
  • Online gambling and betting in jurisdictions where such promotion is restricted.
  • Pharmacies, prescription drugs, health products that make medical claims unsupported by regulatory approval.
  • Hate speech, harassment, or content targeting individuals or groups based on race, religion, gender, sexual orientation, disability, or other protected characteristics.
  • Misinformation or deceptive content designed to mislead recipients.
  • Phishing, malware, or credential-harvesting content of any kind.
  • "Affiliate-only" commercial mail where the sender has no real product or service.

6. Prohibited technical behaviour

You may not:

  • Bypass or attempt to bypass rate limits, send quotas, or other usage controls.
  • Use the API for unauthorised scraping, automation, or load testing of our infrastructure.
  • Probe, scan, or test the security of the Service except as explicitly invited (e.g. a published bug-bounty programme).
  • Distribute malware, ransomware, or links to harmful resources via the Service.
  • Use the Service to support phishing, credential theft, or impersonation.
  • Misuse webhooks to attack third-party endpoints from our infrastructure.

7. Enforcement

When we detect or are notified of a possible AUP violation, we will, at our discretion:

  1. Investigate. We may pause sending, request consent records, or ask you to clarify.
  2. Issue a warning. For first-time, lower-severity issues, a warning with corrective steps may be enough.
  3. Place the Account in Review. Sending is throttled or paused while we investigate. Reviews are typically resolved within 5 working days.
  4. Suspend the Account. Sending is fully paused. We will notify you of the reason and the steps required to lift the suspension.
  5. Permanently terminate the Account. For severe, repeated, or unresolvable violations.

Termination for AUP violation is not refundable. We do not pre-announce takedown for serious violations (e.g. phishing campaigns, illegal content) — we will act and notify you afterwards.

8. Reporting violations

If you have received an unwanted message that you believe was sent through Brixus365, or you suspect a customer is violating this AUP, please report it to:

support@brixus365.com

Include the original email headers if possible. We investigate every report.

9. Changes

We may update this AUP from time to time. Material changes will be announced by email at least 30 days before they take effect.
